Welcome to Captionic! These Terms of Use (“Terms”) govern your access to and use of the Captionic mobile application (the “App”). By downloading, installing, or using the App, you agree to these Terms. If you do not agree with these Terms, you may not use the App.

1. License

Subject to your compliance with these Terms, Captionic grants you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use.

2. User Content

You retain ownership of any content you submit, post, or display on or through the App (“User Content”). By submitting User Content, you grant Captionic a worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, modify, adapt, and publicly display your User Content in connection with operating and providing the App.

3. Prohibited Conduct

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws;
• Impersonate any person or entity or misrepresent your affiliation with any person or entity;
• Interfere with or disrupt the operation of the App or servers or networks connected to the App;
• Attempt to gain unauthorized access to any portion of the App or any other systems or networks connected to the App.

4. Intellectual Property Rights

The App and its content, including but not limited to text, graphics, logos, and images, are the property of Captionic or its licensors and are protected by copyright, trademark, and other intellectual property laws.

5. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. CAPTIONIC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

6. Limitation of Liability

IN NO EVENT SHALL CAPTIONIC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7. Indemnification

You agree to indemnify and hold Captionic harmless from any claims, damages, liabilities, and expenses (including attorneys’ fees) arising out of or in connection with your use of the App or your violation of these Terms.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Country/State], without regard to its conflict of law provisions.

9. Changes to Terms

Captionic reserves the right to update or modify these Terms at any time without prior notice. Any changes will be effective immediately upon posting the updated Terms on the App. Your continued use of the App after the posting of the updated Terms constitutes your acceptance of the changes.
